TSE Bans Pablo Marçal from Electoral Funds and Campaign Debates

The Superior Electoral Court (TSE) unanimously decided on Thursday to temporarily prohibit Pablo Marçal, a candidate for the Presidency representing the PRTB, from accessing electoral and party funds. The ruling also prevents him from participating in campaign debates and appearing in free electoral advertising on radio and television. This precautionary measure remains in effect while the court analyzes the validity of his candidacy registration.

The decision follows an impugnation by the Electoral General Prosecutor's Office (PGE). The relator of the case, Minister Estela Aranha, stated that there is a risk of using public resources for a candidacy that appears legally unviable. Marçal was previously declared ineligible until 2032 by the Regional Electoral Court of São Paulo (TRE-SP) due to the misuse of communication media during his 2024 campaign for Mayor of São Paulo, specifically regarding a competition involving video clips. While the case has not yet reached a final non-appealable judgment, the collective nature of the decision makes him ineligible under Ficha Limpa rules.

Additional disputes involve Marçal's party affiliation. The PGE argues that he failed to join the PRTB within the legal deadline, citing evidence that he presented himself as a member of União Brasil after the April deadline. Marçal's defense contends that he signed the affiliation papers on time and obtained a preliminary injunction to allow the registration process to proceed. Center-right framing suggests the candidacy may be a strategic move to benefit other right-wing figures or inadvertently aid the current president, while center and center-left reports focus primarily on the legal requirements and the court's ruling.
