USCIS Updates Work Permit Validity for TPS Beneficiaries

The U.S. Citizenship and Immigration Services (USCIS) has published updates regarding the validity of Employment Authorization Documents (EAD) for individuals under Temporary Protected Status (TPS) from Burma and Somalia. These extensions follow federal court orders that temporarily suspended the cancellation of the TPS program for both countries. The Department of Homeland Security had previously announced the end of TPS for these citizens after determining that the conditions justifying the protection no longer existed. For beneficiaries from Burma, work permits with original expiration dates of November 25, 2022, May 25, 2024, and November 25, 2025, are now valid until August 7. For beneficiaries from Somalia, permits with original expiration dates of March 17, 2023, September 17, 2024, and March 17, 2026, are valid until August 5. Employers are instructed to record these new dates in Form I-9 and the E-Verify system. These measures remain temporary while litigation continues, specifically following a Supreme Court decision in Mullin v. Doe which limits the ability of courts to review executive determinations regarding the end of TPS designations.
