The Full Federal Court of Australia has unanimously rejected an appeal by right-wing leader Pauline Hanson to overturn a ruling that she racially discriminated against Senator Mehreen Faruqi. The court upheld a 2024 decision finding that Hanson violated racial discrimination laws in a social media post where she told the Muslim Greens senator to "piss off back to Pakistan."
The three-judge panel stated that none of the grounds for appeal were established. They ruled that the comment was unlawful and not protected by free speech defenses, characterizing it as an anti-Muslim and Islamophobic message. The court further noted that the remark was a variant of the racist slogan "go back to where you came from."
The original post occurred two years prior on the day of Queen Elizabeth II's death. It was a response to Senator Faruqi's remarks regarding the British empire being built on stolen lives, land and wealth.
Senator Faruqi stated that justice has prevailed and emphasized that hate speech is not free speech. Pauline Hanson indicated she intends to lodge an appeal with the High Court of Australia. Hanson claimed via X that laws preventing people from expressing personal views have almost totally silenced public discussion in Australia.
