Brazil to Gradually Increase Paternity Leave to 20 Days by 2029

Brazil will gradually increase paternity leave from five days to 20 days by 2029, following the enactment of Law 15.371 signed by President Luiz Inácio Lula da Silva in March. The transition begins in 2027, making Father's Day 2026 the final one celebrated under the current five day limit. The new law also establishes paternity pay through the National Social Security Institute (INSS).

Under the new system, employers will initially pay for the additional leave days and will subsequently be reimbursed by Social Security. While the specific operational details for this reimbursement are still awaiting regulation, legal experts suggest it may follow the existing system for maternity pay through the compensation of social security contributions. For self employed professionals who contribute to Social Security, the INSS will pay the paternity benefit directly. The Ministry of Social Security stated that the regulation process to define these procedures is currently underway.

Legal expert Silvia Lira noted that the change presents financial challenges for companies, particularly by 2029. Beyond the leave itself, businesses will face indirect costs such as FGTS payments and expenses related to the worker's absence. Lira also mentioned that the final stage of the expansion could be delayed if Budgetary Guidelines Law rules are not met.

Experts and parents highlighted the social impact of the change. Darwin Grein, a human development specialist, described the move as a shift in social paradigm that promotes workforce well being and talent retention. Ton Kohler, a father and speaker, emphasized that the first days after birth are fundamental for the connection between fathers and children, noting that the previous five day limit was often insufficient.
