Health Activists Challenge India's Proposed Food Warning Labels in Supreme Court

Indian health activists have filed the first formal court objection to a government proposal regarding red warning labels on packaged foods. The nonprofit group 3S And Our Health submitted a complaint to the Supreme Court arguing that the current proposal creates an industry friendly loophole. Under the proposed rules, a red hexagonal label would only be required if a product exceeds limits in at least two of three nutrients: added sugar, salt, or saturated fat. Activists argue that a product high in only one of these nutrients, such as sugar, still poses a health risk to consumers.

The packaged food and drink industry, valued at over 100 billion dollars, has also expressed opposition to the plan. Industry executives warned that a substantial majority of packaged products could be flagged, which would negatively affect demand. A government source stated that the concerns are unfounded and explained that the rollout would occur in phases. According to the source, the government intends to tighten rules in a second phase by requiring labels for each individual concerning nutrient, though no dates for this phase have been set.

The legal challenge comes as India faces rising obesity rates. A study published in the Lancet noted that India had 180 million overweight or obese adults in 2021, with projections reaching 450 million by 2050. The Supreme Court is scheduled to hear the complaint on September 10.
