Judge Rules Charlie Kirk Murder Suspect Will Face Trial and Potential Death Penalty

Utah District Judge Tony Graf ruled on Tuesday that there is sufficient evidence to proceed to trial for Tyler Robinson, the 23 year old man accused of fatally shooting conservative activist Charlie Kirk. Robinson pleaded not guilty to all seven charges, including aggravated murder. If convicted of aggravated murder, he could face the death penalty. A hearing to schedule the trial date is set for October 23.

Prosecutors allege that on September 10, 2025, Robinson fired a single shot from a rifle while in a prone position on a rooftop more than 400 feet away from the target. The bullet struck 31 year old Kirk in the neck as he addressed a crowd of over 3,000 people at Utah Valley University. Prosecutors presented DNA evidence tying Robinson to the weapon, which belonged to his grandfather, and to a tool used to engrave a cartridge with the words "Hey Fascist! CATCH!"

Regarding the motive, prosecutors cited a text message and a handwritten note sent to a former roommate and romantic partner, in which Robinson allegedly expressed a desire to take out Kirk due to his political views. The defense challenged this, with attorney Richard Novak arguing there is no evidence of Robinson's thoughts on Kirk, while attorney Staci Visser argued that the case does not meet the legal threshold for aggravated murder because only one shot was fired at one victim, creating no high probability of harm to others.

The proceedings were attended by the families of both men. Erika Kirk, the widow of Charlie Kirk and current leader of Turning Point USA, and her parents described the ruling as an important step toward justice. Reports from the courtroom noted that both the Kirk and Robinson families were visibly emotional during the hearing.
