A federal trial began Tuesday in Oakland, California, as a coalition of 29 US states accuses Meta of intentionally designing Facebook and Instagram to be addictive for children and adolescents. Four lead states, including California, Colorado, Kentucky, and New Jersey, argue that Meta exploited the brain chemistry of young users to maximize profit, contributing to a mental health crisis characterized by anxiety, depression, and suicide. The prosecution also alleges that Meta violated the Children's Online Privacy Protection Act by collecting personal data from children under 13 without parental consent.

While the state attorneys general have cited potential penalties of approximately 200 billion dollars, Meta has noted in court documents that fines could reach as high as 1.4 trillion dollars. Beyond monetary damages, the states are seeking a permanent national injunction to force Meta to overhaul its platforms. Proposed changes include the removal of infinite scroll, the elimination of like counts, the implementation of time limits for young users, and the removal of filters that alter facial appearances.
Meta has denied the allegations, stating that the claims are unfounded and that there is no clear research linking social media use to a lack of well-being in adolescents. Defense attorneys argued that the company has developed meaningful tools to improve user safety and that the states' financial demands are disproportionate. Former Meta safety engineer Arturo Bejar testified as the first witness for the states, claiming that safety was often an afterthought in the company's rush to deploy new products like Reels.
Mark Zuckerberg and Instagram head Adam Mosseri are expected to testify. The trial is projected to last between six and eight weeks, with a verdict expected in October. Judge Yvonne Gonzalez Rogers will determine Meta's liability and decide on any civil penalties or required platform changes. Many legal experts have compared the proceedings to the 1990s litigation against the tobacco industry, suggesting this case could serve as a pivotal moment for the regulation of social media platforms.
