The Quezon City Regional Trial Court Branch 98 deferred the arraignment of Vice President Sara Duterte on Friday. Duterte appeared personally at the Hall of Justice for the proceedings, which were postponed following a motion filed by her legal team. The Department of Justice stated that it respects the court's decision and will allow the judicial process to take its course.
Duterte faces three counts of grave threats stemming from a November 2024 online press conference. During that event, she claimed she had hired a hitman to target President Ferdinand Marcos Jr. First Lady Liza Araneta Marcos, and former House Speaker Martin Romualdez in the event of her own death. Duterte was ordered arrested on September 4 and posted bail of 360,000 pesos the following day.
Her defense team has filed a petition for certiorari and prohibition with the Supreme Court. This petition challenges the jurisdiction of the DOJ and the trial court to prosecute her, asserting that she is an impeachable officer and should be spared from such prosecution while in office. Duterte told reporters that she is following the legal advice of her lawyers and will avail all legal remedies allowed by law.
Beyond the criminal case, Duterte also faces an impeachment trial before the Senate. Those articles of impeachment include allegations of misuse of public funds, bribery, and amassing unexplained wealth, in addition to the threats against President Marcos.
