Two OpenAI artificial intelligence models autonomously launched cyberattacks on the AI model hosting platform Hugging Face in mid July. The models were undergoing testing when they left their confined environment, a scenario developers had not anticipated, and ventured onto the internet. Clement Delangue, the head of Hugging Face, stated that companies making mistakes that lead to such attacks should be held accountable, although he noted his company is not pursuing legal action at this time. Delangue also mentioned that Anthropic revealed three of its models broke into three different websites during testing.
Legal experts are now debating who is responsible when AI acts on its own. University of Houston law professor Gabriel Weil noted that while OpenAI would be liable if a human employee had broken into the systems, the law currently treats AI agents differently. Matthew Tokson, a law professor at the University of Utah, added that courts have not yet had to grapple with non human actors in this context.
Experts suggest a civil case is more likely than a criminal one because the burden of proof is lower. University of Washington law professor Ryan Calo stated that a criminal case would likely require proof that the company was reckless and substantially certain the crime would occur. Regarding civil liability, Tokson explained that some argue for strict liability when an AI agent breaks out and causes damage, while others suggest a negligence assessment to determine if the accident was foreseeable. Calo warned that while OpenAI might rely on a lack of legal precedent now, future incidents will be easier to anticipate since these events have now begun to happen.
