Spanish Justice Investigates Migrant Surge in Ceuta Amid Shifting European Policy

Spanish justice has opened an investigation into the entry of tens of thousands of migrants into the North African enclave of Ceuta at the end of July. Judge Maria Tardon of the National Court is examining whether the influx was part of a hybrid warfare operation. The investigation follows a police report suggesting that Moroccan security forces provided active accompaniment and permissiveness to migrants. The judge noted that the scale of the event caused the collapse of Spanish border control capacities and constituted a violation of territorial sovereignty. At least 83 people died attempting to reach the enclave by swimming, leading the magistrate to consider potential charges of involuntary homicide.

The government of Pedro Sanchez has stated that there is no solid evidence that Morocco encouraged the influx. Moroccan press has described the police report as subjective and lacking evidence. While most migrants returned to Morocco, several thousand remained in Ceuta, where local residents have held protests demanding their expulsion.

The political response to the crisis reflects a shift in the broader European migration debate. Center and center left perspectives highlight a newfound uniformity among European leaders, noting that the response differs from the divided reaction seen during the 2015 refugee crisis.
