Spanish Supreme Court Suspends Voting Rights for Some Descendants Under Grandchildren Law

The Spanish Supreme Court has suspended the registration of certain individuals in the Electoral Census of Absent Residents (CERA) who obtained nationality through the Law of Democratic Memory, commonly known as the grandchildren law. The court's decision requires consulates to prove that applicants are descendants of Spaniards exiled for political, ideological, religious, or sexual orientation reasons before they can be registered to vote. This ruling partially accepts a petition filed by the political party Vox and the movement Iustitia Europa.

The dispute centers on a government instruction from October 2022 that presumed the status of exile for all Spaniards who left the country between 1936 and 1955. While the law allows descendants of exiles to claim nationality, the government's presumption of exile for anyone leaving during that period has been contested. According to official data, 2.4 million descendants have applied for nationality under this system, with 544,722 approved and 306,000 already registered as Spaniards.

Framing of the event varies by political lean. Center right sources highlight accusations from conservatives that the government engaged in electoral engineering to fabricate voters through an arbitrary and uncontrolled granting of nationalities. Conversely, the center left framing focuses on the court's action as a halt to the right to vote. Minister Félix Bolaños has urged the Supreme Court to reach a definitive decision before the 2027 general elections, arguing that suspending the right to vote for thousands of citizens is a measure of enormous transcendence that should not have been adopted as a cautionary measure.
