Supreme Federal Court (STF) Minister Flávio Dino determined on Wednesday the immediate reinstatement of Andrei Rodrigues as Director General of the Federal Police and Leandro Almada as Director of Police Intelligence. The decision reverses a preventive removal ordered a day earlier by Minister André Mendonça. Dino ruled that the removal of the officials was an unprecedented measure that could paralyze hundreds of urgent investigations, including those involving corruption in the judiciary and organized crime. He further argued that the request for removal, made by the Novo party, lacked legal legitimacy because political parties are not parties to criminal proceedings.
The conflict stems from a broader institutional crisis involving Ministers Dino, Mendonça, and Alexandre de Moraes. Mendonça had removed Rodrigues after alleging that the Federal Police conducted illegal systematic monitoring of himself and the Attorney General of the Union. This followed a dispute where Moraes used police intelligence reports to accuse Mendonça of abuse of authority, while Mendonça had previously released messages between Moraes and banker Daniel Vorcaro. Dino criticized Mendonça for acting in his own cause and cited a meeting between Mendonça and Vorcaro as a factor that makes the interference in police management more grave.
To secure the reinstatement, Andrei Rodrigues filed a request through a separate investigation regarding parliamentary amendments for the film Dark Horse, which is under Dino's relatorship. This tactical move was highlighted by center right sources as a way to direct the request to a specific minister. In response, Mendonça appealed to STF President Edson Fachin, classifying Dino's decision as illegal. Meanwhile, President Fachin canceled a scheduled plenary session on Wednesday, which was expected to address the jurisdictional impasse.
The Novo party criticized the decision, calling Minister Dino soviet and claiming the court is dysfunctional. The case is now expected to be referred to the Prosecutor General and eventually decided by the full STF plenary.
