STF President Proposes Collective Review of Investigation Into Journalist's Sources

Supreme Court (STF) President Edson Fachin indicated on Thursday that the court will collectively deliberate on recent decisions made by Justice Alexandre de Moraes regarding an investigation into a journalist and his sources. The dispute centers on search and seizure warrants issued against journalist Luís Pablo and his suspected sources, including former Maranhão government secretary Raimundo Cutrim, following reports about Justice Flávio Dino's alleged irregular use of official vehicles in Maranhão. Fachin stated that the court's strength lies in its collegiality and that he would take the necessary steps to ensure these matters are decided with brevity.

Justice Alexandre de Moraes defended the investigation, arguing that the journalist is being investigated for the crime of stalking and for allegedly integrating a criminal association that put Justice Dino and his family at risk. Moraes asserted that while source confidentiality is a constitutional guarantee, it cannot serve as a shield for criminal activities or illicit acts. He further argued that appeals against his decisions should be judged by the STF's First Panel, which includes Justice Dino, rather than the full plenary suggested by Fachin.

Justice Flávio Dino has denied any irregular use of official vehicles, stating that the usage was related to security. He claimed that he and his family were monitored clandestinely, which he described as a threat to their physical safety. In a social media post, Dino stated that his role as a judge requires him to silently endure aggressions and distortions of facts.

The case has sparked a significant debate over the limits of press freedom. Several legal entities and media organizations have criticized the measures as a violation of the constitutional right to source confidentiality. While center and center right sources report on the legal tension between security and press freedom, some center right commentary frames the actions as a favor to a colleague and a disfavor to democracy, suggesting the investigation creates a dangerous precedent for the silencing of investigative journalism.
