The 5th Turma of the Superior Tribunal de Justiça (STJ) unanimously rejected a request on Wednesday to return Alexandre Nardoni and Anna Carolina Jatobá to prison. The two were convicted in 2010 for the 2008 murder of five year old Isabella Nardoni, who was thrown from a sixth floor apartment window. Nardoni was sentenced to 31 years and Jatobá to 26 years. Both are currently serving their sentences in an open regime, with Jatobá progressing in 2023 and Nardoni in 2024.
The request was filed by the Associação do Orgulho LGBTQIAPN+, which is presided over by PSOL state deputy candidate Agripino Magalhães. The association alleged that Nardoni obtained the open regime improperly and that both individuals were violating the rules of their release. Specifically, the association claimed they were circulating in areas of northern Sao Paulo and Barueri at times incompatible with their rules and failed to prove regular work routines. The association also alleged that Jatobá received privileges while imprisoned through Alexandre's father, Antonio Nardoni.
The STJ did not analyze the merits of the allegations. The court rejected the appeal because the association failed to pay the required procedural costs. While the association claimed a right to free legal justice, the court ruled that this allegation alone was insufficient. The decision follows a previous denial of the same request by the Tribunal de Justiça de Sao Paulo (TJ-SP). Defense attorneys for Nardoni and Jatobá did not respond to requests for comment.
