Survivor of Child Sexual Abuse Sues Elon Musk's xAI Over AI Generated Images

A survivor of child sexual abuse has filed a lawsuit in a California district court against Elon Musk's artificial intelligence company, xAI. The plaintiff, identified as Jane Doe to protect her identity, alleges that the chatbot Grok used existing child sexual abuse material (CSAM) to generate new illegal pornographic images depicting her. These images then spread on the social media platform X. According to the complaint, the plaintiff was pre school aged when she was repeatedly raped and forced to produce the original recordings, which have circulated online for approximately 20 years. Attorneys for the plaintiff state that the Canadian Centre for Child Protection used digital fingerprints, known as hashes, to identify that the AI generated images on X depicted their client. This distinction is significant because it provides evidence of a real, identifiable victim, whereas many AI generated cases involve images where the subject cannot be proven to be a real child. The lawsuit claims that xAI ignored industry standard safeguards against sexual abuse material. While Elon Musk stated in January that he was unaware Grok produced images of naked minors, xAI sued two of its own users in late August who face criminal charges for allegedly generating such content. xAI is seeking to have those men pay the costs of lawsuits filed by victims against the company. The complaint suggests the class of affected individuals may include thousands of minors. Neither xAI nor SpaceX returned requests for comment.
