The administration of President Donald Trump has filed an application with the U.S. Supreme Court regarding the dismissal of transgender individuals from the military. The request seeks to remove these service members from duty before a final legal ruling is reached. The Supreme Court has not yet decided whether to take up the case.
In 2025, the Department of Defense ordered a broad exclusion of transgender people from military service under the direction of President Trump. Lower courts previously blocked this move. A court of first instance ruled that the policy violated the constitutional requirement for equal treatment under the law. That court stated the directive, named after Defense Secretary Pete Hegseth, was based at least partially on an impermissible government interest in harming a politically unpopular group.
The U.S. government has called that lower court ruling a serious error. The administration argues that the ability of the armed forces to determine who may serve is a matter of extraordinary importance. President Trump has previously advocated for the exclusion of transgender people during his first term and has claimed that the military has been weakened by a radical gender ideology.
