US Education Department Instructs Schools Against Altering Discipline Policies to Reduce Racial Disparities

The US Education Department's office for civil rights has issued guidance stating that schools cannot modify their discipline policies for the purpose of avoiding or reducing racial disparities. According to a letter from the office, such actions constitute race discrimination and that racial balancing is prohibited. This guidance follows a recent decision by the department to remove several disparate impact regulations that previously prohibited policies with discriminatory effects, even if those effects were unintended.

Federal data from a 2023 Education Department report indicates that Black students are disciplined at disproportionately high rates. The report found that Black public preschool children received out of school suspensions at a rate nearly twice their enrollment. In K-12 public schools, Black boys were nearly twice as likely as white boys to be expelled or receive out of school suspensions, while Black girls were nearly twice as likely as white girls to receive in school suspensions, out of school suspensions, and expulsions.

President Donald Trump has opposed diversity initiatives, describing them as discriminatory against males and white people. Conversely, civil rights advocates argue these actions roll back social progress. Eric Duncan, the director of P-12 policy at EdTrust, criticized the guidance by stating that racial disparities in school discipline cannot be addressed by telling schools to ignore race.
