The Johannesburg Magistrate's Court has dismissed an application by businessman Brown Mogotsi to compel the state to disclose the identities of witnesses in his criminal case. Mogotsi was arrested on 16 May 2026 on a charge of defeating the ends of justice. The prosecution countered that section 144(3)(a) of the Criminal Procedure Act allows for the withholding of such information. The prosecutor alleged that Mogotsi's wife had visited a state witness, creating a threat that justified the redactions.
Sekgatja denied any witness intimidation, stating that the allegation arose from a disagreement between Mogotsi's wife and a neighbor. The magistrate ultimately ruled that the protection of witnesses was an important consideration. The court ordered the state to provide full witness statements to the defense, but without disclosing the names or addresses of the witnesses.
