A federal judge has denied a request by Minnesota officials to compel Texas Governor Greg Abbott to extradite ICE agent Christian Castro. Castro is currently detained in a Texas county jail and faces charges in Hennepin County, Minnesota, for allegedly shooting a man in the leg through a front door during an immigration raid on January 14. The ruling comes as a 90 day limit on the detention of fugitives awaiting extradition in Texas is set to expire on Thursday, meaning Castro could be released if not transferred. Minnesota Attorney General Keith Ellison and Governor Tim Walz sought a temporary restraining order to prevent this release, arguing that Abbott is refusing to act for political reasons.
Texas officials have stated they are investigating whether Castro technically qualifies as a fugitive. Governor Abbott also criticized Minnesota, accusing the state of committing fraud under federal programs and stating he would not respond to them until those issues were addressed. Minnesota officials have expressed concern that Castro may flee to Mexico if released, citing jail calls he made to a woman in Mexico regarding buying a house and marrying her.
