The Regional Electoral Court of São Paulo (TRE-SP) has ordered federal deputy Ricardo Salles of the Novo party to pay a fine of R$ 10 thousand. The court found Salles guilty of early negative electoral propaganda and the dissemination of depreciative content against André do Prado, the president of the Legislative Assembly of São Paulo (Alesp) and a fellow candidate for the Senate. The decision, signed by auxiliary judge Claudia Foncesa Fanucchi, is subject to appeal.
The legal action was initiated by the state directory of the PL party after Salles shared a video on social media questioning why do Prado was chosen by the party for the Senate race. The court determined that the video used digitally manipulated images to artificially associate do Prado with other politicians and depicted him as a marionette. The judge stated that while satire and caricature are protected by freedom of expression, transparency is required when synthetic multimedia content is used in political communication.
Defense lawyers for Salles argued that the post was a legitimate exercise of political criticism based on public facts. They claimed the images were clearly artificial caricatures and that the promotion of the video was intended to support Salles' own pre-candidacy. The defense requested that the case be dismissed or that the fine be kept to a minimum.
