US Government May Require Proof of Parental Citizenship for Children's Passports

The United States government may require parents to provide proof of their own citizenship or immigration status when applying for passports for their children. This potential requirement is part of a preliminary guidance from the State Department intended to implement an executive order issued by President Donald Trump on August 6. The initiative specifically targets birth tourism, which occurs when women travel to the United States to give birth so their children can obtain automatic citizenship.

Under the proposed guidelines, parents or legal guardians would need to present documentation such as a valid US passport, a birth certificate, a Form I-94, or a permanent resident card. This marks a change from current procedures, where parents must prove their relationship to the child and provide photo identification, but are not required to provide documentary proof of their own citizenship status.

The new directive would deny citizenship to children if a parent is classified as a foreign enemy, is involved in fraud or a commercial transaction to obtain citizenship, or works for a foreign government in the US. State Department spokesperson Tommy Pigott stated that the administration aims to protect the meaning and value of American citizenship.

This effort follows a previous attempt by President Trump to limit birthright citizenship, which the Supreme Court ruled illegal in a 6 to 3 decision because it violated the Citizenship Clause of the 14th Amendment. Legal challenges to the current August 6 order are ongoing, with lawyers for affected families seeking to block its implementation in federal court.
