The Delhi High Court on Monday refused to urgently list a petition challenging the Municipal Corporation of Delhi's decision to demolish a building adjacent to a collapsed hostel in Satya Niketan. A bench consisting of Chief Justice D. K. Upadhyaya and Justice Tejas Karia declined the request after a lawyer argued that the demolition proceeded before debris was cleared and that people might still be trapped. The court questioned the basis of these claims, calling them guesswork and stating that the authorities likely conducted a technical audit before the demolition. The court advised the lawyer not to file a petition in air and noted that the matter would be listed in turn.
The original collapse occurred on September 6 at a five storey building used as a boys' paying guest accommodation near Delhi University's South Campus. The incident killed at least seven people and occurred while repair work was underway. Following the collapse, the MCD began a controlled demolition of the adjoining building, which housed a girls' paying guest accommodation, after deeming it dangerous.
Legal and administrative actions have followed the tragedy. The high court previously ordered a high level MCD inquiry, while the Delhi chief minister ordered a magisterial inquiry. Police arrested the property owner, Hariram Gupta, and registered a first information report under the Bharatiya Nyaya Sanhita for charges including culpable homicide not amounting to murder and negligent conduct.
