Democratic-led states sue Trump administration over Endangered Species Act changes

Attorneys general from 20 Democratic-led states and Washington, DC, filed two lawsuits on Wednesday accusing the Trump administration of illegally weakening protections under the 1973 Endangered Species Act. The legal challenges follow final rules announced by the Department of Interior and Department of Commerce that could facilitate development on sensitive lands. One lawsuit specifically challenges a narrowed definition of harm, which previously included threats to species habitats. Under the new rule, activities such as mining and oil drilling may be permitted in these habitats provided they are not directed immediately and intentionally at specific animals. A second lawsuit challenges two additional rules: one that removes broad protections for newly threatened species unless species-specific regulations are created, and another that requires the government to consider objections from private companies before designating critical habitats.

Washington Attorney General Nick Brown stated that the administration is attempting to undermine the law and the will of the people, describing the approach as one of exploitation. Environmental groups have also filed suit regarding the revised definition of harm. In response, a spokesperson for the Interior Department argued that the lawsuits seek to defend regulatory overreach. The department stated that its role is to implement the law as written rather than expanding its reach through interpretations favored by advocacy organizations.
