The Gujarat High Court on Tuesday rejected a petition for temporary bail filed by convicted rapist Asaram, also known as Asumal Harpalani. Asaram, 85, is currently serving a life sentence for the rape of a girl at his Gandhinagar ashram between 2001 and 2006. He had requested a 20 day release on temporary bail after the Gujarat government turned down his request for parole.
Legal counsel for Asaram, Nirupam Nanavaty, argued that the Rajasthan High Court had granted him 20 days of parole in August in a separate rape case due to his age and the fact that he has spent over 13 years in jail. The defense argued that Asaram should receive similar short term relief in Gujarat. The state government opposed the plea, stating that parole and temporary bail are distinct legal processes and that a parole order from Rajasthan does not justify interim release for a conviction in Gujarat.
The court also referenced recent Supreme Court orders regarding Asaram's health. An AIIMS Jodhpur report indicated that he did not require hospitalization but needed round the clock trained caregivers. On August 6, the Supreme Court granted him access to a caregiver in prison and allowed him to approach the court again if his health worsened. The Gujarat High Court bench, consisting of justices Gita Gopi and LS Pirzada, concluded that there was no reason to grant temporary bail at this stage.
