Iquique Court Reverses Block on Transfer of Clan Chen Members to Maximum Security Prison

The Court of Appeals of Iquique has unanimously revoked a previous judicial decision that blocked the transfer of four members of the Clan Chen to the La Laguna prison in Talca. The court ruled that decisions regarding the transfer and segregation of the prison population belong exclusively to Gendarmerie of Chile and that judges should abstain from interfering in these technical determinations. The four individuals, Longdi Chen, Wen Chen, Wu Chen, and Yonjie Chen, are accused of illicit association and money laundering as part of a transnational criminal organization linked to the Chinese mafia.

The initial block had been issued by guarantee judge Diego Reyes, who argued that the defendants had family ties in Iquique and Santiago. However, the Court of Appeals determined that the defendants' criminological profiles and the risks they posed to internal security justified their placement in a maximum security regime. Under this regime, high risk prisoners may spend 22 hours a day in solitary confinement with limited communication.

Government officials have welcomed the ruling as a victory for penal segmentation. Security Minister Martin Arrau stated that the decision ensures high risk individuals are kept in maximum security. President Kast has been more critical of the judiciary, calling on judges to reflect and stating that it is inacceptable for the authority of Gendarmerie to be questioned when isolating dangerous criminals. He further noted that his proposed constitutional reform includes protections for Gendarmerie decisions regarding penal segmentation.
