Spain's Supreme Court has suspended the right to vote for individuals who obtained nationality through the Law of Democratic Memory, commonly known as the grandchildren law. The Contentious Administrative Chamber issued the orders to halt the electoral effects of the law for those already registered in the Census of Absent Residents (CERA) as well as new registrations. The court stated that the measure is temporary and depends on the final ruling of the high tribunal.
The court justified the decision by citing a significant increase in the electoral census. According to the ruling, the CERA census grew from 2,328,260 voters during the 2023 general elections to 408,262 more registered voters as of July 1, 2026, totaling 2,736,522. The court argued that this extraordinary growth creates a founded, real, and serious danger to the objectivity and transparency of the electoral process, which could cause irreversible damage and create uncertainty regarding election results.
