Minister Dias Toffoli of the Tribunal Superior Eleitoral (TSE) has suspended the digital campaign of Renan Santos, the presidential candidate for the Missão party. The decision prohibits the use of social media profiles that were reported to the court after the legal deadline, bars the candidate from participating in debates, podcasts, and interviews, and freezes the use of electoral fund resources. The restrictions also apply to the candidate's running mate, Aroldo Medina. Following the order, YouTube and Instagram removed Santos' accounts in Brazil.
Toffoli based his decision on the fact that Santos informed the court of 16 social media profiles 12 days after his initial registration on August 7. The minister argued that this omission allowed the profiles to remain in platform recommendation algorithms while rivals' accounts were filtered out per 2024 TSE rules. Toffoli stated that this created an unfair advantage and indicated a potential fraud against the law. He has ordered internet providers to preserve content and provide data on posts and boosts, while giving the campaign 24 hours to provide further details or face the possible rejection of the candidacy registration.
Renan Santos has condemned the decision as illegal and persecutory, claiming that technical failures in the TSE registration system caused the delay. He suggested the ruling is a personal retaliation because he organized protests regarding Toffoli's involvement in the Banco Master case. His defense team has announced a writ of mandamus to reverse the measures, arguing that the suspension causes irreparable damage to a campaign that lacks television and radio time.
Within the TSE, the decision has faced internal criticism. Some ministers believe the issue should be handled as a matter of irregular propaganda rather than a challenge to the registration of the candidacy. Jurists cited by some reports described the measure as a legal aberration, noting that election law typically allows candidates to campaign while their registration is under judicial review.
Similar restrictions were also applied to Wilson Grassi Junior, a presidential candidate for the Democrata party, who also failed to report several social media profiles on time.
