US Federal Judge Overturns Trump Administration Visa Restriction for 75 Countries

A federal judge in New York has vacated a Trump administration policy that suspended the processing of permanent residence visas for citizens of 75 countries. Judge Jeannette Vargas ruled on Friday that the policy was contrary to law and exceeded the legal authority of Secretary of State Marco Rubio. The restriction, which had been in effect since January 21, affected nationals from countries including Brazil, Russia, Iran, Afghanistan, Somalia, and Nigeria.

The Trump administration justified the measure by claiming that immigrants from these nations represented a high risk of becoming a public charge or depending on social assistance. However, Judge Vargas found that the policy mandated the refusal of visas based solely on nationality, which undermined the statutory authority of consular officers to conduct individualized assessments of applicants. Evidence presented in the case included an internal State Department cable instructing officials to deny visas even when applicants provided additional evidence of financial self sufficiency.

The ruling was challenged by two nonprofit organizations and 11 individuals. Advocates for the plaintiffs described the ban as cruel and racist, stating that it kept families apart. In response, the State Department stated that the administration is protecting the American people by upholding high screening standards, though it declined to comment on the pending litigation.

This decision is part of a broader pattern of judicial challenges to the Trump administration's immigration agenda. Other contested measures include a revoked visa for the Brazilian ambassador, restrictions on birthright citizenship, and a previously annulled fee for H-1B visas.
